1. Acceptance of Terms
By accessing, browsing, or purchasing from BOREAL MART ("BorealMart", "we", "us", "our") via our website, digital interfaces, or partner channels, you enter into a legally binding agreement and agree to be bound by these Terms of Service.
2. Marketplace Model & Circular Sourcing
BorealMart operates as an online distributor and multi-vendor marketplace dedicated to Canadian commerce. Our catalog includes factory-new items, authorized wholesale lots, manufacturer overstocks, and inspected circular economy/refurbished goods. Every catalog listing discloses an objective 5-tier Condition Grade.
3. Purchases, Final Sale & Consumer Guarantees
To provide deeply discounted pricing, items sold on BorealMart are designated as Final Sale, except as covered under our comprehensive True North Buyer Guarantee (for items arriving damaged in transit, defective, or materially not as described within 7 calendar days). Nothing in these Terms waives mandatory statutory rights available under provincial consumer protection statutes, including the Ontario Consumer Protection Act and Quebec Consumer Protection Act (LPC).
4. User Accounts & Conduct
Users agree to provide accurate, current, and complete registration information. You are solely responsible for maintaining the confidentiality of your credentials. Any fraudulent activity, account spoofing, or attempts to circumvent Canadian sales tax regulations will result in immediate termination of account access and referral to appropriate regulatory authorities.
5. Intellectual Property & Brand Rights
The BorealMart name, logo, orbital maple leaf swoosh, Polaris Gold Star emblem, and proprietary site architecture are protected trademarks and intellectual property of JUAN MORA TRIANA / BOREAL MART. Unauthorized replication is strictly prohibited under the Trademarks Act of Canada.
